Standing Up For What I Knew Was Right

One day when I was driving on the freeway, I was completely blindsided by another car pummeling down the hill. I didn't know what to do or what went wrong, but I knew things were bad. I couldn't feel my feet at first, and my face was covered in liquid that turned out to be blood. When the ambulance arrived I could see the concern on their faces, and it was frustrating to know what was about to come. Fortunately, I was able to get great medical care, and talk with a personal injury attorney that helped me to sort out everything else. Standing Up For What I Knew Was Right

What Happens To Your SSDI When You Don't Follow A Recommended Treatment

by Dylan Tucker

One of the obstacles that some Social Security Disability Insurance (SSDI) applicants face is that they must be suffering from a disability that is considered to be truly debilitating. However, even if you have a disability that should qualify you for SSDI, you may find that you are denied simply because the Social Security Administration (SSA) does not believe that you are taking your injuries seriously.

Refusing To Follow Treatment

One of the most important parts of your SSDI claim is that you must travel to the doctor to receive treatment for your injuries and diagnosis. The medical records created by this visit will be used to prove that you are disabled. You will want to follow the treatment recommendations from your doctor because doing so will help you recover If you do not follow the treatment recommendations, you might be accused of not being as injured as you claim. You may fail to receive your benefits simply for not following the treatment recommendations.

You are required to try to reach the state of maximum improvement even if it is unlikely that you will ever be able to return to work. If it is believed that prescribed treatment will help you return to work, you must participate in it.

What If There Is A Justified Reason

You may have your claim stopped if you fail to follow a treatment. Therefore, you should consider contacting a Social Security Disability lawyer for help. In some cases, you might be able to make an argument that your decision to not receive the treatment was justified. For example, you might have received a second opinion. Or, the treatment might be against your religion and there may be a suitable alternative. Additionally, the treatment might come with side effects so severe that you believe the treatment is worse than the condition itself. Further, the treatment might not have worked and another healthcare provider might recommend it again.

Some doctors will make recommendations that are not considered standard. Therefore, you may need help from a legal representative to explain to the SSA that the recommended treatment is atypical.

Other Medical Conditions Are Considered

You may have another medical condition that could become worsened by the treatment. Also, if you did not receive any treatment because you have a mental health disorder, this may be a valid reason. Contact a social security disability lawyer for more information.
